The RENTER hereby agrees to use the facilities upon the following terms and conditions:

A NON-REFUNDABLE DEPOSIT (amount to be determined based on the event type) payable upon the execution of this Agreement reserves the above date, time, and space. The full amount of the invoice, according to reservations and menu selection, is to be paid at least fifteen (15) days before the Event, when applicable. If the RENTER fails to remit payment by the specified date, or other arrangements have not been made, they will incur a carrying charge of $250. Payments not received fifteen (15) days prior to the Event, when applicable, may result in the cancellation of the Event.

If Venue Access carries beyond the permitted use of the time specified above, the RENTER will be subject to charges of $500.00 per hour for extended use of the Venue beyond the permitted time.

The final price will be determined when the menu and reservations are confirmed. OWNER requires a minimum of fifteen (15) reservations for catered events. Service team, gratuity, and sales tax are not included in the meal price. RENTER further agrees that a twenty-two percent (22%) gratuity will be charged on all food and beverages. Late reservations cannot be accepted after (ten) 10 days prior to the Event.

If the RENTER cancels the event, the deposit remains non-refundable. Additional fees paid may be refunded according to the following schedule:

• 90 or more days before the event: 50% refund of paid fees (excluding deposit).

• Less than 90 days before the event: No refund.

If the OWNER cancels the event due to unforeseen circumstances, all fees, including the deposit, will be fully refunded.

The RENTER further agrees that he/she will not use or occupy said premises for any unlawful purpose; and that the RENTER will conform to and obey all present and future laws, ordinances, rules, regulations, requirements and orders of The United States of America, The State of Ohio, The City of Columbus, and all governmental authorities or agencies, and all municipal departments, bureaus, boards or officials of said city, respecting said premises and the use and occupation thereof; that he/she will not commit or permit any nuisances thereon; that he/she will maintain and keep the premises in a good, clean, and orderly condition, and will restore them to the OWNER in the condition received.

Nothing is to be attached to any walls or furnishings. If outside vendors are used for decoration, the RENTER must coordinate with the OWNER in advance. RENTER further agrees to pay for or repair any damage occasioned to said premises or to any furniture, fixtures, appliances or utensils in or on said premises due to the RENTER’s use or occupancy thereof.

This Facility is non-smoking. Any indication of smoking within the Facility will result in a cleaning fee of $500.00.

RENTER further agrees that, in the event of RENTER’S failure to occupy said premises as hereinbefore stated, RENTER further agrees that the payments herein made and provided for shall be forfeited to the OWNER.

The RENTER shall be responsible for all arrangements in connection with the operation of the bar(s). A licensed bartender is required upon distribution of hard liquor and will be provided by Clintonville Woman's Club. The serving of alcoholic beverages to minors is strictly prohibited. Said RENTER assumes responsibility and liability for any claims whatsoever which may arise out of the use and dispensing of alcohol, at the Facility, and also agrees to hold the OWNER harmless from any such liabilities. Liquor Commission laws are not negotiable, therefore, the RENTER may not have a “CASH BAR” or in any way sell alcohol unless a license is obtained through the State of Ohio. The RENTER may serve complimentary alcohol to lawfully aged persons. The RENTER cannot in any way, directly or indirectly, charge any fee or price for the alcohol, such as asking for donations.

The OWNER’S representative will remain in charge and control of the premises during the rental period hereof for the purpose of safeguarding OWNER’s property, and the RENTER will abide and conform to the representative’s orders and directions for the preservation of said property and the proper conduct of the RENTER in the use thereof, and will leave the said premises at the time herein before mentioned.

RENTER further agrees to hold the OWNER harmless and free from any liability for any acts or actions, causes of action, suits, damages, claims, or demands, arising from or purporting to arise from RENTER’s occupancy of said premises or during the period herein specified as RENTER’s right of possession of the property. In order to ensure your investments, please check this link www.eventsured.com for information regarding Event insurance. The OWNER does not provide any refunds.

The RENTER agrees to adhere to any applicable health regulations, including but not limited to COVID-19 guidelines, local food handling guidelines, and other safety protocols in effect on the date of the Event. Food is not permitted to be taken from the premises.

In the event of market fluctuations, food costs may increase. In the event of price changes, the OWNER reserves the right to adjust the final cost of the menu by up to ten percent (10%). The RENTER will be notified of any adjustments at least thirty (30) days prior to the Event.

Payments can be made by credit card, check, cash, Zelle, or Venmo. Checks should be made payable to Clintonville Woman’s Club Inc. Credit card payments will have a three percent (3%) processing fee. Late payments may incur additional fees beyond the initial carrying charge.

IN WITNESS WHEREOF, THE PARTIES HERETO, HAVE EXECUTED THIS AGREEMENT. EACH INDIVIDUAL SIGNING BELOW ON BEHALF OF A PARTY HEREBY REPRESENTS AND WARRANTS THAT HE OR SHE IS DULY AUTHORIZED AND HAS THE LEGAL CAPACITY TO EXECUTE AND DELIVER THIS AGREEMENT ON BEHALF OF SAID PARTY.
